Secret Sauna – Liability and Media Release Waiver

PLEASE READ CAREFULLY.

This document affects your legal rights. By signing below, you acknowledge and agree to the terms of this release, assumption of risk, and indemnity agreement.

1. Voluntary Participation and Assumption of Risk

   I understand that participation in sauna and related wellness activities at Secret Sauna, located at 7033 NE Glisan Street, Portland, Oregon, involves inherent risks, including but not limited to:

   • Exposure to high heat, dehydration, or fluctuations in blood pressure;

   • Slips, trips, or falls on wet or uneven surfaces (including gravel and stepping stones);

   • Burns from heated metal or stove components;

   • Use of cold water or shower for contrast therapy;

   • Movement between indoor and outdoor areas, including through Replicant bar premises;

   • Risks related to other guests’ conduct, alcohol consumption, or environmental conditions.

   I acknowledge that these risks may result in serious injury or death. I am voluntarily participating with full awareness and accept all risks, both known and unknown.

2. Health Declaration

   Participation in sauna sessions at Secret Sauna is restricted to individuals 18 years of age or older. By signing this agreement, I affirm that I am at least 18 years old and legally competent to consent to this waiver.

   I confirm that I am in good physical condition and not aware of any medical condition that would prevent safe sauna use. 

   I understand that maintaining adequate hydration is my personal responsibility. Drinking water is provided on site, and I agree to monitor my hydration before, during, and after sauna use to reduce risk of heat stress, dehydration, or related symptoms.

   I agree not to use the sauna if I:

   • Am intoxicated or under the influence of drugs or medication that may impair judgment or physical ability;

   • Am pregnant, have cardiovascular, respiratory, or other health conditions for which heat exposure is contraindicated, unless cleared by a physician;

   • Have open wounds, contagious conditions, or skin infections.

   I acknowledge that I have been advised to consult a qualified physician before using sauna facilities if I have, or suspect I may have, any medical condition or concern.

   I understand that staff members of Secret Sauna are not medical professionals and do not provide medical advice. Participation in sauna activities is undertaken solely at my own risk, even if staff are present or provide general guidance.

   I agree to exit immediately if I feel dizzy, nauseous, or unwell.

3. Release of Claims

   In exchange for being permitted to use the facilities of Secret Sauna and access through Replicant, I hereby release, discharge, and hold harmless SJM Services LLC dba Secret Sauna, Replicant LLC, their owners, employees, agents, contractors, landlords, and affiliates (“Released Parties”) from any and all claims, damages, losses, or causes of action arising out of or related to:

   • My use of the sauna, shower, changing area, outdoor seating, or surrounding property;

   • Slips, trips, or falls occurring on wet, uneven, or gravel surfaces;

   • Accidents occurring inside Replicant while walking to or from the sauna, including those caused by water tracked indoors or slippery shoes;

   • Any negligence (other than gross negligence or willful misconduct) by the Released Parties.

   I understand that this release extends to all physical areas used by guests of Secret Sauna and Replicant in conjunction with the sauna experience.

4. Indemnity

   I agree (to the fullest extent permitted by law) to defend, indemnify, and hold harmless the Released Parties from any claims, actions, damages (including costs or attorney’s fees), or causes of action brought by third parties arising out of my participation, conduct, or failure to follow posted safety rules.

5. Conduct and Facility Rules

   I agree to abide by all posted and communicated rules, including but not limited to:

   • Wearing appropriate attire at all times (i.e. swimwear, athletic clothing, or equivalent);

   • Sitting on a towel inside the sauna;

   • Using caution on wet, uneven, or gravel surfaces;

   • Avoiding or carefully monitoring alcohol consumption before or during sauna use;

   • Respecting all guests and staff, maintaining appropriate behavior and attire at all times.

   Public nudity is not permitted, including inside the sauna during social sessions. During private session bookings, nudity is allowed at the guest's discretion inside the sauna only. In all other situations, guests must wear a bathing suit or other suitable athletic clothing such as a sports bra and shorts in shared areas. A robe or other appropriate covering and shoes or sandals are required when entering or moving through the adjoining bar area.

   Failure to comply may result in removal from the premises without refund.

   Right to Refuse Service

   Secret Sauna, in its sole and absolute discretion and without liability for damages or lost payments, reserves the right to refuse service or deny admission to any person whose behavior, condition, or conduct poses a safety or comfort risk to themselves, other guests, or staff. This includes, but is not limited to, individuals who appear intoxicated, disruptive, aggressive, or otherwise unfit to participate safely.

   Refunds will not be provided in cases of refused admission or early removal from the premises.

6. Media Release

   I grant Secret Sauna permission to photograph, record, or film me during my visit and to use my likeness for marketing, social media, or promotional purposes, without payment or further consent.

   I waive any right to inspect or approve materials in which my likeness appears and release Secret Sauna, its affiliates, and contractors from all claims arising from such use.

   (Guests may opt out of media use by notifying staff before their session.)

7. Medical Treatment Authorization

   I authorize Secret Sauna staff to obtain emergency medical assistance if necessary and agree to be financially responsible for any resulting expenses.

   I understand and agree that Secret Sauna staff are not medically trained, and any assistance they may provide in the event of illness or injury is rendered voluntarily and as a courtesy. Such assistance shall not be construed as the assumption of any duty of care or admission of liability by Secret Sauna or its staff.

8. Severability and Jurisdiction

   If any provision of this waiver is found invalid, the remainder shall remain in full effect.

   This agreement shall be governed by Oregon law, and any disputes shall be resolved in Multnomah County, Oregon.

9. Acknowledgment of Understanding

   I have carefully read this document, fully understand its contents, and sign it voluntarily.

   I acknowledge that I am waiving substantial legal rights, including the right to sue.

10. Continuing Effect

    This agreement shall remain in full force and effect for all current and future visits or use of Secret Sauna facilities by the undersigned unless and until revoked in writing by the participant, or replaced by a subsequent waiver executed by the participant. Any such updated waiver shall supersede this agreement as of the date it is signed. Revocation or replacement shall not affect the validity of this agreement for any activities or occurrences that took place prior to that date.
